In consideration of the privilege of using Captain Lee’s Marina pool, and in recognition that swimming in an unguarded pool is an inherently dangerous activity, I intending to be legally bound, hereby waive for myself, my underage children, my guardians, heirs, executor, administrators, legal representatives and any other persons on my behalf, any and all rights and claims for damages, demands and any other actions whatsoever, including those attributable to Captain Lee’s Marina and those persons or entities’,associated with me participating in the activities at the Pool, Marina, or land associated with the premises.
I understand that this Waiver of Liability and Assumption of Risk shall remain in effect at all times that this Agreement remains in force. I understand that should I decline to execute this agreement; I will not be permitted to enter Captain Lee’s Marina’s Pool. I understand and acknowledge that there will be no lifeguard on duty and I, my guests, family members and others associated with me agree to swim at our own risk and at all times abide by the Rules and Regulations attached hereto and incorporated herein.
Applicant shall indemnify and hold harmless Captain Lee’sMarina, its officers, employees, agents and employees, from and against any and all claims, damages, suits, losses and expenses, including attorney’s fees, for injury or death to persons or damage to property arising out of or resulting from the use of property and facilities of, or the exercise and enjoyment of membership privileges in the Captain Lee’s Marina pool by the you, your family and guests. I also agree that if there is any part of this contract I do not understand, I will seek outside counsel for clarification before agreeing and/or signing this agreement.
